(Operation Trucking Brownout)
To all of my fellow truck drivers, as you may know we are in full swing of "Operation Black and Blue". I realize that many of you are wondering how you can be effectual for the cause while you are busy at work on the road, besides displaying a sign about the cause on your trucks.
The plan is as simple as running legal. That's right! Everything that you do on elog or paper you account for your time like the FMCSA requires. No more logging in the sleeper berth or off duty while at the dock, no more logging in the sleeper berth or off duty when you are in the course of performing any part of your job, including your time while standing at the dispatch window, or waiting at the shop for the truck to be finished. Yes, I know that you aren't paid by the hour, and you feel that you need to conserve your available on duty time to make money, but that's the whole point. You don't get paid for that, and you should. Trucking companies will take advantage of you, and they refuse to stand up against all of this government overreach. They will ask you to do something that they themselves refuse to do, because they know that what we are up against is unreasonable.
The purpose of this action is to prove that the FMCSA hours of service rules don't work, as well as electronic logging devices. What will happen is that you will run out of hours while being loaded, or unloaded and then the company will have to deal with their customers on how the matter will be handled. You will run out of hours, and the company will not be able to perform timely deliveries and pick ups. This will create a burden on the industry as a whole, so we expect for trucking companies, as well as shippers and receivers to be in contact with authorities to get these ridiculous rules changed.
This is a viable plan that you can easily participate in, because it is perfectly legal. You can't be fired for refusing to break the law. Remember the FMCSA rules 392.3 "Ill and fatigued", 396.7 "Unsafe Condition", and 390.6 "Coercion Prohibited". The FMCSA has given us the tools we need to make our point quite clear, that the hours of service rules don't work, and the electronic logging devices are unacceptable, and we are not criminals nor will we be treated like criminals.
